eB2B Procurement Platform Terms and conditions 

§1
 
1. Definitions:
 

eB2B Platform Administrator - eB2B sp. z o. o. with headquarters in Warsaw on Al. KEN 51 premises U21 acting as technical support and cooperating with users of eB2B Procurement Platform. The administrator shall render its knowledge and experience to users in providing a failure-free operation of the eB2B system. The administrator is not a party to the agreements, commitments or other mutual relations entered into between the participants.

Password - A confidential string of alphabets, digits, or others entered into the Procurement Platform generated in the eB2B system that user can change at any time, while using the Procurement Platform. The password allows you to log into the Procurement Platform and make use of its functions.

eB2B procurement Platform - is an application designed for the management of end-to-end procurement process, in particular, for managing purchase requisitions, document workflow, purchase accounting, management of agreements, vendors, and purchase planning.

The platform is used for the organization of requests for quotations, auctions and electronic bidding, including public procurement as defined by the Public Procurement Law (Journal Of Laws of 2007 No. 223, item 1655, as amended). The functionality of eB2B Platform may vary depending on the terms of the license agreement.

Regulations - these Regulations binding each user of eB2B Procurement Platform.

 
2. User - defined in the Procurement Platform as a user with a unique username and access password to the eB2B Procurement Platform.
 
3. The use of eB2B Platform for any other purpose requires the consent of the owner of eB2B sp. z o. o. with its registered headquarters in Warsaw, hereafter referred to as eB2B. The platform is available at https://bsh.eb2b.com.pl. It is also possible to install the Platform to the subdomain of an eB2B client.

4. The use of eB2B Platform for all bidders is free of charge
 
§2
 
1. eB2B is not liable for damages resulting from irregularities in the system. Liability for lost profits is excluded.
 
§3
 
1. eB2B platform works with all standard browsers, eB2B recommends using the latest versions of web browsers. eB2B is not liable for irregularities resulting from the use by users of older versions of browsers than: Mozilla Firefox 22+; Google Chrome 24+; Internet Explorer 9+; Opera 10+; Safari 5+; Maxthon 3+
 
 2. eB2B uses the IP addresses of users to verify the users' activity, examine protests in e-tender processes, diagnose problems related to server operations and analyze safety violations. This information is linked with personal details of users.
 
§4
 
1. A user has the right to use eB2B Platform, in particular to collect and enter data and print reports, provided they do not infringe copyright law and the rights of registered trademarks belonging to eB2B.
 
2. No part of the site can be wholly or partly copied for commercial purposes, transmitted electronically or otherwise modified, linked or used without prior written consent of eB2B sp. z o. o. with registered office in Warsaw.
 
§5
 
1. eB2B is not liable for form and content of information posted on the site by its users, particularly in terms of current news, accuracy, completeness, detail and relevance of the information to specific users of the system. The website of the Platform may contain links to other sites ‘www', which may be the property of, or run by third parties not affiliated to eB2B. In using the eB2B Platform, users accept that eB2B is not liable for exactitude, content or availability of information found on the eB2B Platform.
 
§6
 
1. eB2B is not liable for use of the system by users in a manner contrary to the provisions of these Regulations.
 
2. eB2B may deactivate any user of the system, if there is any reason to believe that the site is used in a manner contrary to the provisions of these Regulations, or if user enters incorrect or false data.
 
§7
 
1. eB2B warns that any attempt: to gain access to information stored in the system, breaking or circumventing the electronic or IT safety precautions, destruction, damage, removal or alteration of data stored in the system and the disruption of the operation of the site undertaken by an unauthorized person shall be prosecuted under the laws of the Republic of Poland, in particularly by virtue of the Act of 6 June 1997 - Penal Code (Journal of Laws No.88, item 553 as amended).
 
§8
 
1. eB2B reserves the rights to modify this site at any time. In using the eB2B Platform, the user accepts the terms and conditions.Changes to these Regulations enter into force 30 days after its publication.
 
2. The user at any time has access to the Rules of the eB2B Platform. Rules modifications require re-acceptance.
 
§9
 
1. All rights to all or part of the eB2B Platform, all the graphics components, layout of the Site, and other components are reserved. eB2B Platform and all its elements are protected by law, in particular the Act of 4 February 1994 on Copyright and Related Rights (consolidated text. Journal of Laws 00.80.904 as amended), the Act of 16 April 1993 on combating unfair competition (Journal of Laws 93.47.211 as amended) and the Act of 27 July 2001 on the protection of databases (Journal of Laws 01.128.1402).
 
§10
 
1. Using the eB2B Platform means that you consent to the disclosure of personal data entered. Users who have questions regarding the operation of the portal, privacy protection, practices employed by eB2B or ways to maintain contact with eB2B are kindly requested to send comments to: admin@eb2b.com.pl
 
§11
 
1. The User consents to the processing of personal data contained in the registration form for the purpose of participation in procurement processes organized on the platform administered by eB2B, pursuant to the Polish Act of 29 August, 1997 on the protection of personal data. (Journal of Laws 2002 No. 101, item. 926, as amended)

2. The user of eB2B Platform consents to the processing of personal data by eB2B Sp. z o. o. with registered office in Warsaw for technical, statistical purposes and may consent to the processing of personal data by eB2B Sp. z o. o to the marketing purposes by selecting respective check-box regarding the open awarding procedure notification in the registration form.
 
§12
 
1. Users of the site can modify their personal data at any time. In specific circumstances, using the electronic signature, edition of personal data may be performed by the eB2B Administrator at the request of a user.
 
§13
 
1. eB2B Platform uses the so called cookie files. Cookies are text information stored by the eB2B server on a user's computer, which the server can read each time the user connects to this computer. The user must accept cookies to user the Service. The user at any time can disable option to accept cookies in the web browser however it will hinder the use of the Service.
 
§14
 
1. eB2B reserves the right to unilaterally amend or modify these Rules. Use of the platform after the introduction of these changes is tantamount to consenting to the above-mentioned changes and modifications.

These Regulations enter into force as of 1 January 2016
